This privacy statement covers the domain PaxGuard.com. This statement demonstrates our commitment to our merchant’s privacy and the privacy of their customers. This statement covers the following topics, generally considered the most sensitive to merchants concerned about their privacy:

Information Collection and Use:

Information Collection

Internet Payment Solutions is the sole owner of the information collected on PaxGuard.com. Internet Payment Solutions collects information from our merchants at several different points on our Web site.

Registration

In order to register for our service a merchant must first complete the registration form. During registration a merchant is required to give contact information (such as name and email address).

Information Use

The information provided to us by the merchant is used only to ensure we can collect payment from the merchant, and to contact the merchant in the event there is a problem with their account, or to respond to merchant inquiries.

Cookies

A cookie is a piece of data stored on the merchant’s computer tied to information about the merchant. PaxGuard.com uses cookies on this site. We do link the information we store in cookies to any personally identifiable information you submit while on our site.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s help file.

We set a persistent cookie to enable us to track and target the interests of our merchants to enhance the experience on our site. If you reject cookies, you may still use our site, but some of your preferences may not be maintained from one visit to the next.

Profile

We do not store information collected through third parties to create a profile of our merchants. A “profile” is stored information kept on individual merchants that details their viewing preferences. PaxGuard.com does not use persistent cookies nor in any way store information on the merchant’s computer that could be used to build a customer profile. Internet Payment Solutions, Inc., uses log files only to track web site usage. These log files do not contain information that is tied to unique merchants or their use of our site.

Third Party Advertising

PaxGuard.com does not serve ads on its Web site, therefore no information about merchants or their behavior is developed or maintained by third-party advertisers.

Log Files

Like most standard web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track merchant’s movement in the aggregate, and gather broad demographic information for aggregate use.

Communications from the Site:

Service Announcements

On rare occasions it is necessary to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance we might send merchants an email. Generally, merchants may not opt-out of these communications, though they can deactivate their account, which will effectively remove them from the list of merchants to whom these communications are sent. However, these communications are not promotional in nature.

Customer Service

We communicate with merchants on a regular basis to provide requested services and with regard to issues relating to their account. We reply via email or phone, in accordance with the merchant’s wishes.

Legal Disclaimer

Though we make every effort to preserve merchant privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our web site.

Third Party Advertisers

Internet Payment Solutions, Inc., does not share Web site usage information about merchants with any third party for the purpose of targeting our Internet banner advertisements on this site and other sites.

Service Providers

We partner with other third parties to provide specific products or services. When the merchant signs up for one of these particular services, we share names, or other contact information like email address, name, address, and phone number, as well as other accounts that merchant has on that particular third party’s service, that is necessary for the third party to provide these services. These third parties’ use of that personally identifiable information is subject to their own privacy policies.

Business Transitions

In the event Internet Payment Solutions, Inc., goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, merchants’ personal information will, in most instances, be part of the assets transferred. Merchants will be notified via email and prominent notice on our Web site for 30 days prior to a change of ownership or control of their personal information. If as a result of the business transition, the merchants’ personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

Choice/Opt-out

Out of respect for our merchants we do not send any promotional or marketing materials. Merchants of our site will always be notified when their information is being collected by any outside parties. We do this so our merchants can make an informed choice as to whether or not they should proceed with services that require an outside party.

This Web site contains links to other sites. Please be aware that we, Internet Payment Solutions, Inc., are not responsible for the privacy practices of such other sites. We encourage our merchants to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.

Security

This Web site takes every precaution to protect our merchants’ information. When merchants submit sensitive information via the Web site, their information is protected both online and off-line.

When our registration/order form asks merchants to enter sensitive information (such as financial or checking account information), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when merchants are just ‘surfing’. While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect merchant-information off-line. All of our merchants’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees or contractors who need the information to perform a specific job (for example, our account management service representatives are granted access to personally identifiable information. Our employees or contractors must use password-protected screen-savers when they leave their desk unattended. When they return, they must re-enter their password to re-gain access to merchant information. Furthermore, ALL employees are kept up-to-date on our security and privacy practices. At the time of hire and every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our merchants’ information is protected. Finally, the servers that store personally identifiable information are in a secure environment, in a locked facility.

Supplementation of Information

In order for this Web site to properly fulfill its obligation to merchants it is necessary for us to supplement the information we receive with information from third party sources (see “Bank Account Verification”).

Bank Account Verification

To determine if merchants have provided valid bank account information and have funds available in their checking account, we will use the information they provide to contact their financial institution before processing their order. This is analogous to a credit card validation and authorization, and a corresponding check for available credit.

Correcting/Updating Personal Information

If a merchant’s personally identifiable information changes (such as zip code, phone, email or postal address), we provide a way to correct or update merchants’ personally identifiable information. This can be done by emailing our Customer Service

Notification of Changes

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our merchants are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use merchants’ personally identifiable information in a manner different from that stated at the time of collection we will notify merchants via email. Merchants will have a choice as to whether or not we use their information in this different manner.
